Important Notice:

Off-road motorcycle racing is inherently dangerous and carries the risk of serious injury or death, including permanent disablement. By participating in the EMX Sparks British Masters series, you acknowledge these risks. It’s crucial to understand and accept these risks, taking full responsibility for your actions and involvement.

Before participating, you must read, accept, and sign a Consent and Safety & Risk Declaration Form. Additionally, you’ll need to familiarise yourself with the EMX Sparks Rules, Regulations, and Etiquette, available at race sign-in. Adherence to all posted notices, instructions, and warnings, or those communicated by EMX representatives, is mandatory.

Should you have any doubts about your ability to participate or questions regarding these terms, the booking process, or safety declarations, please consult a staff member before committing.

Acknowledgement of the risks of motorsport

Motorsport is an extremely dangerous activity. It is important that all competitors think very carefully about the risks they are undertaking whenever they compete.

It must be recognised by all competitors that there will be accidents and that a number of competitors may die, whilst others may be permanently disabled or sustain serious injuries and it could be you. All competitors must appreciate that they participate in motorsport entirely at their own risk.

One of the main risks in motorsport is obviously speed. Situations which would not give rise to major danger at low speed can have extremely serious consequences at high speed and in a competitive environment.

While the organisers will do their reasonable best to make the event as safe as possible, there will inevitably be occasions when mistakes are made. It must, however, be recognised by all competitors that where an accident occurs in such circumstances, any fault on the part of the organisers will not be the principal cause of any serious injury sustained. The dominant cause of any serious injury will be the fact that the accident happened at speed in a competitive environment. The risk of accidents is one of the inherent risks involved in motorsport and every competitor must consent to this.

The EMX is not prepared to accept personal injury claims brought by competitors who have willingly participated in what they know to be a dangerous sport. Any claims will be vigorously defended, and the signing on form will be used as evidence of the competitor’s acknowledgement of the risks inherent in motorsport and that the dominant cause of any serious injury will be his/her voluntary decision to engage in competitive sport rather than any alleged negligence by EMX or any other party involved in staging the event.

1. Booking and Payment:

1.1 Participation in any scheduled EMX Sparks British Masters race or activity is governed by these terms. The combination of your completed and signed booking form (for payments not made in advance), these terms, the Consent and Safety & Risk Declaration Form, and the EMX Sparks Rules constitutes the full agreement between you (‘the Participant’) and EMX Sparks.

1.2 Group bookings: “You” includes all group members. It’s the organiser’s duty to ensure every group member has read and agreed to these terms.

1.3 Your booking, via a completed form and full payment, must be received before participating in any event.

1.4 Bookings are confirmed upon full payment, which is non-refundable.

1.5 Payments are accepted via debit or credit card.

1.6 All participants must sign a Medical Consent Form before using the facilities. It’s your responsibility to inform EMX Sparks of any changes in medical conditions.

2. Cancellations by EMX Sparks:

Efforts are made to ensure all events proceed as scheduled. However, EMX Sparks reserves the right to cancel events due to adverse conditions or other uncontrollable factors. In such cases, we may offer an alternative date or a refund at our discretion.

2.2 Bookings not fully paid a week in advance may be canceled, forfeiting any deposit.

2.3 If one or more blocks of racing have been completed before the event’s cancellation, these races will be considered valid and will count towards the final series results. Under these circumstances, no refunds will be issued, reflecting the resources and planning invested to facilitate these completed portions of the event

3. Cancellation by You:

3.1 Changes of mind are acknowledged. We offer refunds for cancellations notified 7 days or more before the event, processed within 14 days.

3.2 Cancellations within 7 days of the event start will not be refunded.

4. Liability:

4.1 EMX Sparks does not limit liability for personal injury resulting from our negligence.

5. Equipment, Instruction, & Supervision:

5.1 Participants using their equipment must ensure it’s fit for purpose. EMX Sparks reserves the right to inspect and disapprove the use of inadequate equipment.

6. Under 18s:

Minors require a signed Medical Consent Form and Safety Declaration by a parent or guardian to participate.

7. Data Protection / Privacy:

Your information is protected under the Data Protection Act 1998. Photographs for publicity and CCTV for security may be used, indicating consent upon booking submission.

8. Adherence to Rules:

Participants must fully comply with EMX Sparks rules and instructions.

9. General:

Designated areas are specified for eating, drinking, and non-smoking. Influenced individuals by alcohol or drugs will be prohibited from participation.

10. Your Obligations:

Participants must pay all required fees and respect the facilities and other users, leaving areas clean and orderly.

5.2 The training and instruction you will receive is specific to the PMX environment.  We can not guarantee that the skills learnt on any PMX activity will be transferable to any other       activity which carries different inherent risks.  

5.3 In booking and participating in a PMX activity you agree to follow the directions and orders of any PMX instructor.   

6. Under 18s 

All persons under the age of 18 years (‘Under 18’s’) will require a completed Medical Consent Form and Safety and Risk Declaration signed by an appropriate parent or legal guardian before being allowed to participate in any activity at PMX.  The requisite consent form is available from us and a duly completed and signed consent form must be returned prior to  participation.  

7. Data Protection / Privacy 

7.1 The information you have supplied will be treated in accordance with the provisions of the Data Protection Act 1998.

7.2 We may occasionally take photographs of Participants for publicity purposes, including reproduction on our website, and in submitting your booking you are indicating your consent to the same, unless you mark the box on the consent and safety risk declaration form or booking form to indicate otherwise.

7.3 We may use CCTV to monitor our premises for security purposes and to review any incidents which may occur on the premises.

7.4 We will use your email address to contact you with information about our services and special offers.

8. Adherence to Rules 

8.1 You must comply at all times fully and promptly with the PMX Rules, Regulations and Etiquette and any and all other safety regulations and instructions issued by us, our staff and/  or our instructors from time to time.

8.2 You must not do anything (or omit to do anything) which may cause damage or loss to our property or facilities, to other participants or cause nuisance, annoyance, disturbance, inconvenience or injury to any other persons on the premises.

8.3     We reserve the right to terminate the stay/use of the Facilities by any person(s) whom we reasonably consider to be in breach of these terms and conditions, and such persons may be required to leave PMX immediately. No refunds will be made in this event, and we will not accept liability for any expenses, claims, losses or costs  incurred as a result of such termination. 

9.   General 

9.1 Eating and drinking are only permitted in the designated  areas. 

9.2 Smoking & non-prescription drugs are not permitted anywhere within PMX inc. car park. Anyone in possession of or under the influence of any such items will be refused admission. 

9.3 Any persons who are thought to be under the influence of drink / and or drugs (at the sole discretion of PMX staff) will not be permitted to use PMX facilities and partake in any  activities. No refund will be given 

9.4 If you wish to send us any notice or letters then you should send it to the address and for the attention of the relevant person you wish to contact. If you are unsure as to whom to  send any notice or letter, then please send it to Pembrey MX, Pembrey Circuit, Llanelli, Carmarthenshire SA16 0HZ.  

9.5 For the purposes of the Contracts (Right of third Parties) Act 1999 this agreement is not intended to, and does not, give any person who is not a party to it any right to enforce any of  its provisions. 

9.6 This agreement is governed and construed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the courts of England and Wales.  We must be notified of lost property within 6 weeks, as any items found are disposed of after this period.  

10.    Your Obligations 

10.1    You will pay the sums required under this agreement in accordance with the programme set.  

10.2    You must ensure that all users under this Agreement behave in a manner that is respectful to the Facility and the users thereof. 

10.3    You must ensure that all parts of the Facility used by your participants are left in a clean and orderly manner and that all defects are reported to the site management.
